Introduction:
VÉRA D’ORO welcomes you. Below, you will find the terms and conditions regulating your use of this store and all legal implications resulting from your use of the store’s services via the internet. By using the store, whether as a consumer of a service or product or otherwise, this constitutes an approval and acceptance by you—while being in your full legal and statutory capacity—of all articles and provisions of this agreement. It is a confirmation of your commitment to its regulations and what is mentioned therein. This agreement applies to all types of dealings between the consumer and the store. This agreement is considered valid and effective once you agree to it and start registering with the store under Article 10 of the Saudi Electronic Transactions Law.
Article 1 - Introduction and Definitions:
The above preamble is considered an integral part of this agreement. Below are the indications and definitions of the main terms used in this agreement:
- (The Store): This definition includes all forms of the store on the internet, whether it is an electronic application, a website, or a commercial shop.
- (The Consumer): The person who deals with electronic commerce desiring to obtain products or services provided by the store via its electronic platform.
- (The Agreement): This term refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
Article 2 - Consumer Legal Capacity:
- The Consumer acknowledges that they have a legal capacity considered by law and Sharia to deal with the store, or that they are at least eighteen years of age.
- The Consumer agrees that in the event of violating this article, they shall bear the consequences of such violation before third parties.
Article 3 - Nature of Obligation:
- The Store’s obligation to Consumers is to provide (the Service or Product).
- The Store may provide other services such as after-sales services or other related services, depending on the nature and type of (the Service or Product) requested by the Consumer.
Article 4 - Usage Controls:
- The Consumer is committed to using the electronic platform of the Store in a manner consistent with public morals and the regulations in force in the Kingdom of Saudi Arabia.
- When purchasing a service or product from this Store, the Consumer is committed not to use this service or product in violation of public morals and the regulations in force in the Kingdom of Saudi Arabia.
Article 5 - Accounts and Registration Obligations:
Upon applying to join this Store as a user, you are committed to disclosing specific information and choosing a username and a secret password to use when accessing the Store’s services. By doing so, you have agreed to:
- Be responsible for maintaining the confidentiality of your account information and password, and you agree to inform the Store immediately of any unauthorized use of your account or any other breach of your confidential information.
- The Store will not be liable in any way for any loss, direct or indirect, moral or material, resulting from the disclosure of the Consumer's username or password.
- You are committed to using your account or membership with the Store yourself, as you are fully responsible for it. In the event that others use it, this is a presumption that you have authorized them to use the Store in your name and for your account.
- You are committed to using the Store with all seriousness and credibility.
- You are committed to disclosing true, correct, updated, complete, and legal information about yourself as required during registration with the Store and are committed to updating your data if it changes in reality or if needed.
- Our Store is committed to treating your personal information and contact addresses with strict confidentiality.
- If it becomes clear to the Store that you have disclosed information that is untrue, incorrect, not current, incomplete, illegal, or in violation of what is stated in the User Agreement, the Store has the right to stop, freeze, or cancel your membership, store, or account on the platform, without prejudice to the Store’s other rights and its legitimate means to recover its rights and protect other consumers.
- In case of non-compliance with any of the above, the Store management has the right to stop or cancel your store or membership or block you from accessing the Store’s services again.
Article 6 - Electronic Communications and Official Means of Communication:
- The parties to this agreement agree that communication shall be via the email registered on the platform.
- The Consumer agrees that all agreements, advertisements, data, and other communications provided electronically stand in place of their written counterparts and are a standalone argument in meeting statutory and legal needs.
- The Consumer agrees to the possibility of communicating with them and notifying them of any provisions concerning this agreement or dealing with them through the Store management broadcasting general messages to all consumers or to specific users of the Store.
Article 7 - Amendments to the User Agreement and Fees:
- In the event that any article or clause mentioned in this agreement is canceled or if there is any article or clause in this agreement that is no longer effective, such a matter does not negate the validity of the remaining articles, clauses, rules, and provisions in this agreement, which shall remain in effect until further notice from the Store management.
- This agreement—which is amended from time to time as the case may require—constitutes the mechanism of work, understanding, and agreement between (The Consumer) and (The Store).
- The Store may impose fees on some consumers depending on the offers, products, or services they request or fees or taxes imposed by the state on the nature of the product or service.
- The Store reserves the right to add, increase, reduce, or deduct any fees or expenses under the articles, clauses, and provisions of the User Agreement solely on any of the consumers for whatever reason for their registration.
Article 8 - Payment and Settlement Services:
- The Store provides, through its partners, the payment and settlement system in the Store. It can be done entirely online through the payment options available on the Store or through any payment method provided by the Store from time to time.
- The Store is committed to determining the price of the service or product it displays in its store according to the recognized market value.
- The Store is committed to providing invoices and receipt vouchers for all amounts and profits arising in its store and is committed to giving the Consumer an invoice for their purchase of a service or product.
- The Store is committed to providing the recognized accounting specifications in its electronic store, in application of the provisions of this agreement, and for the legal, economic, commercial, and regulatory interests in this organization.
Article 9 - Intellectual Property:
- The intellectual property rights of the Store are fully owned by the Store, whether they were owned by them before the establishment of this electronic platform or after its establishment.
- The Consumer respects the intellectual property rights of the Store, which includes the Store's name itself, and the words, logos, and other symbols specific to the Store or displayed on it, as every right belonging to the Store’s name is a fully owned intellectual property right of the Store.
Article 10 - Store Responsibility:
- The Store is committed to practicing its commercial work through this electronic platform regularly and in accordance with the regulations in force in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement.
- The Store does not bear any claims arising from errors or negligence, whether resulting directly, indirectly, accidentally, or through the Consumer or through a third party such as shipping companies.
- (VÉRA D’ORO), its employees, owners, and representatives are committed to ensuring that (the Product or Service) is sound, legal, and authorized according to the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.
Article 11 - Restriction of Access or Membership:
The Store may stop or cancel the Consumer's membership or restrict the Consumer's access to the platform's services at any time, without warning, for any reason, and without limitation.
Article 12 - Applicable Law or Regulation:
This User Agreement is governed and drafted according to the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and is completely and fully subject to the regulations in force by the authorities in the Kingdom of Saudi Arabia.
Article 13 - General Provisions:
In the event of the cancellation of any article or clause mentioned in this User Agreement or if there is any article or clause in the User Agreement that is no longer effective, such a matter does not negate the validity of the remaining articles, clauses, and provisions in the User Agreement, which shall remain in effect until further notice from the Store management.
This User Agreement—which may be amended from time to time as the case may require—constitutes the User Agreement, work mechanism, understanding, agreement, and contract between the Store and the Consumer. Both parties to this agreement agree to take into account the following:
- The Arabic language is the language in force when interpreting the provisions of this agreement or when translating it into another language.
- All prices displayed on the Store’s services or products may be modified from time to time.
- Promotional or marketing offers that the Store may place are temporary offers, as the Store has the right to modify these promotional or marketing offers at any time or stop them.
- The parties to this agreement are committed to dealing with each other in a manner that does not violate the Sharia rules, regulations, and laws in force related to the nature of the dealing between the Store and the Consumer.
- This User Agreement is not canceled except by a decision issued by the Store management.
